Terms of Use
Black History Facts
Last updated: 15 October 2026
These terms are the agreement between you and Oye Ventures Ltd ("we", "us" or "our"), 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, for your use of the Black History Facts app and this website. Registered in England and Wales.
By downloading or using the app you agree to these terms. If you don't agree, please don't use the app. Our Privacy Policy explains how we handle your personal information.
1. What Black History Facts is
Black History Facts is an educational app with:
- facts, essays and quotations about Black history
- quizzes
- photographs
Some of it is free, and the rest needs a Premium subscription.
2. Who can use it
Anyone can read the free content without an account. You need to be 13 or over to create an account. If you're under 18, you need a parent's or guardian's permission to buy a subscription.
3. Your account
- Give accurate information when you create your account, and keep your sign-in details safe.
- You're responsible for what happens under your account. Tell us straight away if you think someone else is using it.
- You can delete your account at any time in the app: open the You tab, scroll to Account and tap Delete account.
4. Premium subscriptions
What you get. Premium unlocks the full library and the features described in the app when you buy it.
Price. The price and billing period are shown in the app and on the App Store or Google Play before you buy. Prices can vary by country and include any taxes the store collects.
Payment and renewal on the App Store.
- Payment is charged to your Apple ID when you confirm your purchase.
- Your subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the period ends.
- The renewal charge is taken within the 24 hours before the current period ends.
Payment and renewal on Google Play.
- Payment is charged to your Google Play account when you confirm your purchase.
- Your subscription renews automatically, and you're charged at the start of each new period, unless you cancel before then.
Cancelling.
- On iPhone, open Settings, tap your name, then Subscriptions. On Android, open Google Play, then Payments & subscriptions, then Subscriptions.
- When you cancel, you keep Premium until the end of the period you've paid for.
- Deleting the app or your account does not cancel your subscription.
Free trials. If we offer a free trial, the app will tell you how long it lasts. Unless you cancel before the trial ends (at least 24 hours before, on the App Store), the subscription will start and you'll be charged.
Refunds. Apple and Google take all payments, so refund requests go to them, under their own policies. Use reportaproblem.apple.com for Apple purchases, or Google Play's refund request for Google purchases. Nothing in these terms affects your legal rights as a consumer.
Price changes. If the price of your subscription changes, Apple or Google will tell you in advance, as their rules require. You can cancel before the new price applies.
Using Premium on another device. Sign in with the same account. You can also use Restore Purchases in the app.
5. Using our content
What you may do. You may use the app and its content for your own personal, non-commercial learning. You may also show it in a classroom, a home-education setting, a book club or a similar non-commercial setting. You may share individual cards with the app's share button, as long as the Black History Facts credit stays on them.
What you may not do. Unless we agree in writing, and except where the law allows you to, you may not:
- copy, republish or sell our content, or large parts of it
- scrape or download it in bulk
- use it to train artificial intelligence models or build datasets
- remove credits or copyright notices
Who owns the content. The app's text, design and selection of material belong to us or are used with permission.
- Quotations belong to their authors and are quoted for education, criticism and review.
- Photographs belong to their creators. They are used under their own licences (public domain, CC0, CC BY or CC BY-SA), which are credited under "About this photo". Your use of a photograph outside the app is governed by its licence.
6. Accuracy
We research our content carefully and correct mistakes when we find them. History is complex, though: sources sometimes disagree, many dates are approximate, and our understanding changes over time. The content is for general education and isn't professional advice. If you spot an error, please tell us through our Contact page.
Some content deals with slavery, violence and racism, which some readers may find distressing. Parent/Teacher mode offers child-friendly versions for younger readers.
7. Fair play
When you use the app, please don't:
- choose a display name that is offensive, impersonates someone or contains someone else's personal information
- cheat on quizzes, or manipulate scores, the leaderboard or Versus challenges
- try to get around the Premium paywall or interfere with the app or our servers
- copy, change or reverse-engineer the app, except where the law allows you to
- use bots or automated tools with the app
- use the app for anything unlawful
We may change or remove display names and scores that break these rules. In serious or repeated cases, we may also suspend or close accounts, as explained in section 9.
Your private notes are stored only on your device. You're responsible for them, and we can't recover them if the app is deleted.
8. Changes to the app
We may change the app and its content. We'll only do so for one of these reasons:
- to add or improve content and features
- to correct errors
- to keep the app secure
- to reflect changes in the law or in Apple's or Google's rules
- to change which items are free
We'll try to keep the app available, but we can't promise it will always be uninterrupted or error-free.
If we make a change that significantly reduces what Premium offers, we'll tell you in advance, and you can cancel. If we ever stop offering Premium, we'll keep it working until the end of every period you've already paid for.
9. Ending this agreement
You can stop using the app and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these terms. Where we reasonably can, we'll tell you why first.
10. Our responsibility to you
What we're responsible for. If we break these terms or fail to use reasonable care and skill, we're responsible for loss or damage you suffer that was foreseeable. Loss is foreseeable if it was obvious it would happen, or if we both knew it might happen when you agreed to these terms.
What we're not responsible for. We're not responsible for:
- loss or damage that wasn't foreseeable
- business losses, because the app is for personal and educational use
- problems caused by your device, your internet connection, or events outside our reasonable control
Damage to your device. If the app damages your device or other digital content you own, and this is because we didn't use reasonable care and skill, we'll either repair the damage or pay you compensation.
What we don't limit. Nothing in these terms limits our liability for:
- death or personal injury caused by our negligence
- fraud
- damage to your device or digital content, as described above
- anything else the law doesn't allow us to limit
Nothing in these terms affects your legal rights as a consumer. Those rights include the right to digital content that is as described, fit for purpose and of satisfactory quality.
Limit on our liability. Apart from the things we don't limit, our total liability to you is limited to whichever is higher: £100, or the amount you paid for Premium in the 12 months before the event that caused the loss.
11. If you downloaded the app from the Apple App Store
These terms are between you and us, not Apple. Apple's Licensed Application End User License Agreement covers your licence to the app itself. These terms cover the service, your account and Premium. If the two conflict on anything other than the licence to the app, these terms apply.
In addition:
- Apple is not responsible for the app or its content.
- Your licence to use the app is non-transferable. It is limited to Apple-branded devices that you own or control, as allowed by the App Store's Usage Rules, except that the app may be used by other accounts in your Family Sharing group where the App Store allows this.
- We, not Apple, are solely responsible for maintenance and support of the app. Apple has no obligation to provide any.
- We, not Apple, are solely responsible for any warranties, whether stated or implied by law, to the extent they haven't been effectively disclaimed. If the app fails to meet any applicable warranty, you may tell Apple, and Apple will refund the purchase price (if any) you paid for the app. As far as the law allows, Apple has no other warranty obligation for the app. Any other claims, losses or costs from a failure to meet a warranty are our responsibility, not Apple's.
- We, not Apple, are responsible for dealing with any claims you or others make about the app or your use of it, including:
- product liability claims
- claims that the app fails to meet legal or regulatory requirements
- claims under consumer protection, privacy or similar laws
- claims that the app infringes someone else's intellectual property
- You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
- You must also follow any third-party terms that apply when you use the app, such as your mobile network's terms.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you.
If you downloaded the app from Google Play, Google Play's terms also apply to your purchases.
12. Changes to these terms
We may update these terms for the reasons listed in section 8, or to make them clearer. We'll change the date at the top. If a change is significant, we'll tell you in the app before it takes effect. If you don't agree to the new terms, you can stop using the app and cancel your subscription.
13. Other important terms
- Governing law. These terms are governed by the law of England and Wales.
- You can bring legal proceedings in the courts of England and Wales.
- If you live in Scotland or Northern Ireland, you can also bring proceedings there.
- If you live elsewhere, you keep any protections given to you by the consumer laws of your country.
- Severability. If a court finds part of these terms can't be enforced, the rest still applies.
- Waiver. If we delay enforcing these terms, we can still enforce them later.
- Transfer. We may transfer this agreement to another organisation, and we'll tell you if we do. Your rights won't be reduced as a result.
- Third-party rights. Apart from Apple, as set out in section 11, no one else has rights under these terms.
